According to officials from Arkansas Tobacco Control (ATC), the main worry is the unknown ingredients lurking in many products that are sold in retail stores.

Starting in May, the ATC had already reached out to permit holders, letting them know that numerous vape products sitting on their shelves were on the verge of becoming illegal. Retailers now must buckle down and ensure that the products they offer are either authorized or currently under review by the Federal Drug Administration (FDA). Presently, only a meager 39 e-cigarette products hold FDA approval.

The law explicitly restricts designs, labels, or promotions that might appeal to minors—think cartoon characters or names that sound like delicious treats, like “cake” or “candy.” If vendors don’t comply and continue to use such marketing gimmicks after August 5, they risk having their products seized, face hefty fines, or even have their permits revoked.

The enforcement of this new law kicks off on September 1, giving retailers a grace period until November 1 to ensure they’re fully compliant. Non-compliance will mean facing penalties, possibly amounting to $1,000 for each product that doesn’t meet the new criteria.

Marketed as a smoking cessation aid, Zyn pouches are filled with either synthetically-produced nicotine salt or naturally derived nicotine from tobacco. Impressively, Zyn captured over 70% of the nicotine pouch market in the U.S. since 2023. It’s even the sole brand available at select retailers!

As if that wasn’t enough, the surge in Zyn’s popularity can be attributed to influencers and media figures promoting it on platforms like TikTok and various podcasts, further amplifying its reach among younger crowds. The FDA even authorized Zyn for marketing as of January 2025, encompassing a wide array of 20 flavors and strengths—following a substantial social media push.

While nicotine pouches seem to be trending, concerns over their long-term health effects continue to loom. They might pose risks to our youth, increasing the likelihood of future addiction.
